1. Information We Collect

We collect the following categories of information:

  • Photographer details: name, mobile number, email, studio name, city, state, address
  • Guest details: name and mobile number, provided when accessing an event
  • Biometric data: a facial scan/image used to generate a mathematical face embedding, for both photographers' guests and any face used to match photos
  • Event photos uploaded by photographers
  • Payment information processed via our payment partner, Razorpay (we do not store full card details)

2. How We Use Biometric (Face) Data

Face scans are used exclusively to generate a numerical face embedding used for matching a person to photos within the specific event they are part of. We do not use face data for any other purpose, including advertising, profiling, or sharing with third parties. Raw face images may be discarded after embedding generation, depending on the feature (e.g. for face matching only the embedding is retained).

3. Legal Basis & Consent

By scanning your face on the Platform, you consent to the processing of your biometric data for the purpose of matching you to your photos within that event, in accordance with India's Digital Personal Data Protection Act, 2023 (DPDP Act) and applicable data protection laws.

4. Data Retention

Event photos and associated face data are retained for the duration of the photographer's active plan for that event, plus a reasonable grace period. Photographers may delete individual photos or entire events at any time, which removes associated face data from our active systems.

5. Data Sharing

We do not sell personal or biometric data. Data may be shared with service providers strictly necessary to operate the Platform (e.g. cloud storage, payment processing, SMS/OTP delivery), under confidentiality obligations.

6. Your Rights

You may request access to, correction of, or deletion of your personal or biometric data by contacting us at info@fotoso.app. We will respond in accordance with applicable law.

7. Security

We use reasonable technical and organizational measures, including encryption in transit and access controls, to protect your data. However, no method of transmission or storage is 100% secure.

8. Children's Data

The Platform is not directed at children under 18. If a minor appears in event photos, their guardian's consent is the responsibility of the photographer organizing the event.
